Who these terms apply to

These Terms of Service ("Terms") form a legal agreement between you and Mother Node LLC ("First Outside," "we," "us," "our"), operator of the First Outside mobile application and related services. By creating an account or using the app, you agree to these Terms.

You must be at least 18 years old to use First Outside. The app is designed for parents and caregivers of children ages 0–5. It is not a children's app and is not intended for use by minors.

Your account

• You are responsible for maintaining the security of your account and any activity under it
• You must provide a valid email address to create an account
• Sign-in links are sent to your email — each link expires in 15 minutes and is single-use
• Do not share your sign-in links with anyone
• You may delete your account at any time from the Profile screen or by emailing hello@firstoutside.com
• We may suspend or terminate accounts that violate these Terms

Assumption of risk — outdoor activities

By using First Outside, you acknowledge and agree that:

• You voluntarily assume all risks associated with any outdoor activity you choose to do with your child
• First Outside provides activity ideas, preparation guidance, and location information — not professional medical, safety, or childcare advice
• Activity difficulty ratings, age ranges, and duration estimates are general guidelines only. You are responsible for assessing whether any activity is appropriate for your child's specific age, developmental stage, health conditions, and abilities
• Weather, terrain, and conditions at any location can change unexpectedly. Always check current conditions before going out
• Sun safety tips and health guidance in the app are informational only and are not a substitute for advice from your child's pediatrician
• First Outside is not responsible for any injury, illness, loss, or damage arising from your participation in any activity found through the app

What First Outside provides

First Outside is an information and discovery tool. We provide:

• Curated outdoor activity ideas matched to your child's age range
• Nearby park and outdoor space discovery
• Preparation guidance (gear suggestions, sun safety tips)
• Adventure history and activity saving

We do not provide:

• Medical or pediatric health advice
• Professional safety assessments of any specific location
• Guarantees about the accuracy, completeness, or currency of park information
• Real-time hazard or condition alerts

Geographic availability

First Outside is currently available only in the Charlotte, NC metropolitan area. We verify your ZIP code during sign-up. Access may be restricted or expanded at our discretion as we grow to new markets.

Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to any part of the app or our systems
• Scrape, copy, or redistribute app content without permission
• Submit false, misleading, or harmful content
• Impersonate another person or create multiple accounts to evade a suspension
• Use the app in any way that could harm other users or third parties

Affiliate links

Some gear recommendations in the Smart Prep Kit may include affiliate links. If you purchase through one of these links, we may receive a small commission at no additional cost to you. We only recommend products we'd use with our own children. Affiliate relationships do not influence which items appear in the kit.

Intellectual property

All content in the First Outside app — including activity descriptions, design, photography, illustrations, and copy — is owned by Mother Node LLC or licensed for use. You may not reproduce, distribute, or create derivative works from our content without written permission.

Disclaimer of warranties

First Outside is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the app will be error-free, uninterrupted, or that information in the app is accurate, complete, or current. Your use of the app is at your own risk.

Limitation of liability

To the fullest extent permitted by law, Mother Node LLC, its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of First Outside or any activity conducted as a result of information found in the app — including but not limited to personal injury, property damage, or data loss.

Our total liability to you for any claim arising from use of the app is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Mother Node LLC and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app, your violation of these Terms, or any activity you conduct based on information from the app.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email at least 14 days before they take effect. Continued use of the app after that date means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes will be resolved in the courts of Mecklenburg County, North Carolina.
